RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2014-01764
COUNSEL: NONE
HEARING DESIRED: NO
APPLICANT REQUESTS THAT:
He be credited with 20 years of satisfactory service and entitled
to a Reserve retirement.
APPLICANT CONTENDS THAT:
He completed more than 20 years of service towards a Reserve
retirement; however, the records at the Air Reserve Personnel
Center (ARPC) reflect that he was two months short.
He was advised that he did not receive point credit towards
retirement from Apr 88 Dec 89; however, he has a special order
which shows he was present 100 percent of the time in 1989. In
addition, he attended the Senior Noncommissioned Officer Academy
(SRNCOA) [sic] in Apr 87 and was honored with the Commandants
Award.
The applicant provides no rationale as to why his failure to
timely file should be waived in the interest of justice.
The applicants complete submission, with attachments, is at
Exhibit A.
STATEMENT OF FACTS:
According to ARPC IMT 168, Computation of Points and Satisfactory
Service Credit Summary, dated 13 Oct 13, the applicant initially
entered the Regular Air Force on 1 Jul 69. Upon his release from
active duty, on 19 Apr 75, he transferred to the Air Force Reserve
and then the Air National Guard (ANG).
On 28 Aug 90, the applicant was placed on the Temporary Disability
Retired List (TDRL) with a compensable disability rating of
40 percent. He was credited with 21 years, 1 month, and 27 days
of service for basic pay and 6 years, 8 months, and 14 days of
active duty service.
On 13 Sep 92, the applicant was removed from the TDRL and
transferred to the Permanent Disability Retired List (PDRL).
AIR FORCE EVALUATION:
ARPC/DPTT recommends denial.
DPTT records indicate the applicant received 54 active duty points
for Retention/Retirement (R/R) year 19 Apr 86 to 18 Apr 87 and
44 active duty points for R/R year 19 Apr 87 to 18 Apr 88.
The applicant provides the special order for his New Mexico
Perfect Attendance Ribbon from 1 Jan 89 to 31 Dec 89 [sic] in an
attempt to gain credit for a satisfactory year of service for R/R
year 19 Apr 89 to 18 Apr 90. Unfortunately, this order only
covers seven months of the member's R/R year and doesn't reflect
any of the member's individual participation dates. ARPC is
unable to use this award order as a source document because it is
missing creditable points or days of participation. In order for
ARPC to add additional points to the applicant's points history,
he will need to send in source documents for all of the
participation points earned in the year he is requesting points to
be added.
The complete DPTT evaluation is at Exhibit C.
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 4 Oct 14 for review and comment within 30 days (Exhibit D). As
of this date, no response has been received by this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicants complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force Reserve office of primary
responsibility and adopt its rationale as the basis for our
conclusion the applicant has not been the victim of an error of
injustice. Therefore, in the absence of evidence to the contrary,
we find no basis to recommend granting the requested relief.
THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

On 26 Oct 04, the applicant was selected for promotion to the Reserve grade of major (O-4) with a date of rank and promotion effective date of 1 Oct 98. On 10 Apr 06, as a result of the applicants request before the AFBCMR (AFBCMR Docket Number BC-2004-03564) to restore lost points, lost pay, compensation for lost promotion opportunities, retirement consideration, correct his DD Form 214, and correct his reserve status after separation from the Regular Air Force, a directive was published...

On 16 Jan 99, he was activated and served on active duty in the Regular Air Force with a Reserve commission. In order to establish eligibility for Reserve Retirement under the provision of Title 10 U.S.C, Section 12731, a member must complete 20 years of satisfactory service. The applicant first entered active Reserve status on 31 Oct 91, so that date established his R/R year.

The erroneous DD Form 214, documenting a released from active duty date of 30 Sep 07, credits the applicant with more than the requisite 18 years of total active service and would provide a basis for his claims. ARPC records support the conclusion the DD Form 214 was in error and the re-issued form reflects the applicants accrued time as 16 years, 4 months, and 6 days of active service. The applicant contends he had attained more than 18 years of total active service, thus qualifying him...

The applicant did not have an MSD at the time he was in the Honorary Retired Reserve; he will retire with 26 years, 8 months, and 11 days of satisfactory service. If that period is counted as part of his 28 years of commissioned service in establishing his MSD, as it currently is, it denies him the opportunity to actually perform 28 years of service, since he was not permitted to serve for pay or points during the one year, one month, and four day period as an honorary retiree. The...

According to HQ ARPC/DPP, he has 43 points for R/R Mar 99-Mar 00; 50 points are needed for a satisfactory year. The applicant did complete the F/Y 99 requirement of 12 active duty (AD) points and 48 IDT by participating for 10 points during Sep 99; however, these points were actually the first points earned for his 8 Mar-7 Mar 00 R/R year. Before his R/R date was ever changed, he had completed all training day and active duty requirements, based on the information he had at the time, by Feb 99.
